Summary


Certificates of Relief from Disabilities and Certificates of Good Conduct - issued by the state - help formerly incarcerated individuals to overcome the barriers to employment that exist because of a criminal conviction. And they can restore other rights lost after a conviction.

There are provisions in state law that can help the formerly incarcerated to successfully return to life in society. The state corrections law and the city and state human rights laws prevent public and private employers from denying a job or a license because of a criminal conviction. A criminal conviction can only be used to deny a job or a license if a direct relationship exists between it and the job or employing the individual would pose an unreasonable risk to persons or property.

Certificate of Relief from Disabilities can be granted to persons with only one felony and/or any number of misdemeanor convictions. Certificate of Good Conduct can be granted to those with multiple felony convictions. They generally have the same effect, but only a Certificate of Good Conduct can remove felony or misdemeanor bans on holding public office.

In response to this situation, the New York City Reentry Roundtable, a project of CSS, was launched in December 2005 to provide a forum to discuss issues and identify public policy solutions to assist the formerly incarcerated in New York State. Providing help to getting a job The Reentry Roundtable has developed a number of proposals that address unfair obstacles faced by the formerly incarcerated, including legislation that protects employers from negligent lawsuits when they comply with state law encouraging employment of individuals with criminal records.
